1Acceptance of the terms

These Terms and Conditions ("Terms") govern access to and use of the CartaTuil platform, operated by Fidooo LLC ("Fidooo Engineering"), including the application, the website and the digital menus published via QR codes (the "Service"). By registering, ticking the acceptance box or using the Service, you declare that you have read, understood and accepted these Terms and our Privacy Policy.

If you accept on behalf of a business, you declare that you have authority to bind that business. If you disagree with any part, you must not use the Service.

2Description of the service

CartaTuil allows restaurants, cafés and other food businesses to create and publish a digital menu accessible via a link and a QR code, as well as to manage products, prices, photos and videos.

CartaTuil is a menu presentation tool. Unless expressly stated otherwise, it does not process payments from the diner nor act as an intermediary in the sale of food: the commercial relationship, the preparation and the delivery of the products are the sole responsibility of the business.

3Account and registration

You must provide truthful, complete and up-to-date information when registering.

You are responsible for keeping your password confidential and for all activity carried out from your account.

You must be of legal age and have the legal capacity to contract in your jurisdiction.

Notify us immediately of any unauthorised use of your account.

4Business content

You are solely responsible for the content you upload (dish names, descriptions, prices, allergens, photos and videos). By publishing it, you declare and warrant that:

The information — in particular prices, availability and ingredients/allergens — is accurate and up to date.

You hold the rights to the images and videos you upload, or you are authorised to use them.

The content complies with the applicable regulations of your country (labelling, health and safety, advertising and consumer protection).

You grant us a non-exclusive, worldwide licence to host, display and technically adapt that content for the sole purpose of operating the Service (for example, resizing and optimising images).

5Acceptable use

You agree not to use the Service to:

Publish illegal, misleading or offensive content, or content that infringes the rights of third parties.

Compromise the security of the platform, scrape data in an automated way or overload the infrastructure.

Impersonate others or publish menus of businesses you do not represent.

Resell or sublicense the Service without our written authorisation.

6Plans and payments

CartaTuil offers a free one-month trial, no card required. Paid plans are billed in advance and renew automatically unless cancelled; their prices and conditions are disclosed before you subscribe. We also offer one-time setup services, whose scope and price are disclosed before you purchase them.

The price you subscribe at is the price you are billed while you keep your subscription and your plan. If you switch plans, or if you cancel and subscribe again later, the price in effect at that moment applies.

If we ever had to adjust the price of an active subscription, we will notify you at least 15 days in advance and explain the reasons. You may cancel before the adjustment takes effect.

Amounts already paid are non-refundable unless applicable law provides otherwise.

7Intellectual property

The Service, its software, brand, logos, and design are owned by Fidooo LLC ("Fidooo Engineering"), owner of the CartaTuil brand, or its licensors, and are protected by intellectual property laws. These Terms do not transfer any rights to our brand to you. The content you upload remains yours.

8Service availability

We strive to keep the Service available, but there may be interruptions due to maintenance, updates, or force majeure. The Service is provided "as is" and "as available," without guarantee of uninterrupted or error-free operation.

9Suspension and termination

You may stop using the Service and request account termination at any time. We may suspend or cancel accounts that violate these Terms or pose a risk to the platform or third parties.

Upon termination, your public menu will no longer be accessible, and we may delete associated content in accordance with our Privacy Policy.

10Limitation of liability

To the maximum extent permitted by law, CartaTuil shall not be liable for indirect, incidental, or lost profit damages arising from the use of the Service, nor for the accuracy of content published by businesses (prices, allergens, availability). The relationship with the diner and the quality of products are the responsibility of the business.

11Changes to terms

We may update these Terms to reflect changes in the Service or regulations. We will notify you of relevant changes via the app or email. Continued use of the Service after its effective date implies acceptance of the new version.

12Governing law and contact

CartaTuil is a service of Fidooo LLC ("Fidooo Engineering"), with operations in Bolivia and Argentina. These Terms are governed by the laws of Bolivia and Argentina, as applicable to the country from which the Service is provided to your business, without prejudice to the rights recognized by the law of your jurisdiction as a consumer.
